1. Acceptance of Terms

By accessing or using SBOMCheck ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

SBOMCheck provides software bill of materials (SBOM) enrichment for FDA 510(k) and PMA submissions, including maintenance status and end-of-support date enrichment for SPDX and CycloneDX SBOMs.

3. Account and Use

You must provide accurate registration information and keep your account secure. You are responsible for all activity under your account. You may not use the Service for illegal purposes or in a way that could harm the Service or others.

4. Data and SBOM Content

SBOM files and enrichment results are stored to provide the Service. We do not use your SBOM content to train models or share it with third parties for marketing. See our Privacy Statement for details.

5. No Professional Advice

SBOMCheck is an aid for regulatory preparation. It does not constitute legal, regulatory, or compliance advice. You are responsible for ensuring that your submissions and use of enriched data comply with applicable laws and FDA requirements.

6. Subscription and Payment

Paid plans are billed via Lemon Squeezy. Fees are as stated at the time of purchase. Refunds are subject to our refund policy and Lemon Squeezy's terms. All paid offerings are premade subscription plans only. Disputes may be raised via the contact or support options on our website; payment-related disputes may also be resolved through Lemon Squeezy's process where applicable.

7. Termination

We may suspend or terminate your access if you breach these terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases.

8. Disclaimer of Warranties

The Service is provided "as is." We do not warrant that it will be uninterrupted or error-free. Enrichment data is sourced from third parties; we do not guarantee its accuracy or completeness.

9. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Changes

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes may be communicated via email or a notice in the Service.
